Imogi the point is that tribes will sometimes attack out of war...it's not against the rules and I hope it never will be. Btw I expect and REALLY hope staff never does anything to help their friends

This has been debated over and over again. Yes attacking into an alli at war is possible but looked down upon. And like cecil said the thing that you should do is just to kill him after your war is over.
